Terms of Service

Effective October 21, 2026

These terms are the agreement between you and Hometown Club LLC for using Hometown Club, whether you run a business on it or joined a business’s membership. Sections 5 and 6 explain who is responsible for what, because a membership is between a business and its members, not with us.

1. Agreeing to these terms

Hometown Club is run by Hometown Club LLC, a Pennsylvania limited liability company (“Hometown Club”, “we”, “us”). By creating an account, joining a membership, or otherwise using the service, you agree to these terms. If you do not agree, do not use Hometown Club. If you sign up for a business, you agree for that business too and confirm you are allowed to.

Our Privacy Policy explains what we do with personal information and is part of this agreement.

2. Who may use Hometown Club

  • Business owners and staff must be at least 18 and able to enter into a contract.
  • Members must be at least 13 (16 in the EEA and UK). Members under 18 need a parent or guardian’s permission, and a business may set a higher age for its own memberships.
  • Age-restricted perks, such as beer or wine, are for those of legal age only. Hometown Club does not check anyone’s age; the business does, at the counter, as it would for any sale.

3. Your account

  • Give accurate information and keep it up to date.
  • Keep your password to yourself. You are responsible for what happens under your account, so tell us (or, as a member, the business) promptly if you think someone else has access.
  • Treat your member card’s link like a key: anyone who has it can show your card. A business can replace it if it has been shared.
  • Owners are responsible for the staff they invite and the check-in devices they pair, and should remove them when they are no longer needed.

4. What Hometown Club is, and is not

Hometown Club is software that lets local businesses sell and run paid memberships: member pages, sign-up and payments, member cards, check-in, perk use and the records that go with them.

We are not the seller of any membership. The business is. We are not a party to the agreement between a business and its members, and we do not hold members’ money. Members pay the business through the business’s own Stripe account, or at the counter, and we take no share of it.

5. If you run a business

You are responsible for your memberships and your dealings with your members, including:

  • Describing your memberships, events, perks and prices accurately, and honoring them.
  • Your own terms with your members, including refunds, cancellations and anything you promise them.
  • Taxes on what you sell, and any licenses your business needs.
  • Making sure your memberships and perks are lawful where you are, including alcohol laws: checking ID before serving age-restricted perks, and any limits on free or discounted drinks.
  • Having a lawful reason to collect and use your members’ information, telling them how you use it, and handling their requests about it. We process it for you as described in the Privacy Policy.
  • Your Stripe account. Taking payments online needs your own Stripe account, under Stripe’s terms. Stripe, not Hometown Club, handles your payouts, disputes and chargebacks.
  • Recording payments taken at the counter correctly.

Disputes between a business and its members are between them. We may help where we can, but we are not a party to them.

6. If you are a member

  • Your membership is with the business you joined. Its perks, prices, renewals, refunds and rules are set by that business, and questions about them go to the business first.
  • Memberships that renew by card renew automatically at the end of each term until you turn off auto-renew, which you can do in your account at any time. Your membership then runs to the end of the term you paid for.
  • A business may pause, end or change memberships under its own terms, and may refuse a perk if its rules are not met.
  • Show your card when you visit. Perks are for you (and anyone on your household membership), not to be shared or resold.

7. Plans, the free trial and refunds

This section applies to businesses.

  • Free trial. A new business gets 30 days free, with no card needed. Nothing is charged unless you choose a plan.
  • Plans renew until canceled. A plan is billed monthly or yearly, in advance, at the price shown when you choose it, plus any sales tax. It renews automatically at the end of each period until you cancel. Payments are processed by Stripe, which may act as the seller of record.
  • Canceling. You can cancel at any time in Settings. Your plan runs to the end of the period you have paid for, and is not charged again.
  • Refunds. Payments for a period that has started are not refunded, in whole or in part, including when you cancel or move to a smaller plan, except where the law requires a refund.
  • Changing plans. Moving to a bigger plan takes effect right away, and the difference for the rest of the period is charged then. Moving to a smaller plan, or from yearly to monthly, takes effect when the paid period ends. Each plan has the limits shown on our pricing page, and features beyond a smaller plan’s limits switch off when it starts.
  • Price changes. We may change our prices. A new price applies from your next renewal, and we will tell you before it does.
  • If a plan is not paid. When a free trial ends without a plan, or a plan ends or cannot be paid, your business is paused: your member pages and check-in show that they are unavailable until you choose a plan. Your data is kept, and you can still sign in, choose a plan and export your data. Members’ own renewals with your business are not affected by your plan with us.

8. Messages to members

Businesses can send their members notifications through Hometown Club, including news and offers. Send only messages about your own business, to your own members, that they would expect from you. Members choose whether to receive them and can switch them off at any time. We limit how often news can be sent and may remove the ability to send for misuse.

9. Acceptable use

You agree not to:

  • Break the law, or use Hometown Club to help anyone else break it.
  • Sell anything illegal, or anything you are not licensed to sell, through a membership.
  • Harass, threaten, mislead or defraud anyone, including members, staff or our support team.
  • Impersonate another person or business.
  • Interfere with the service, probe it for weaknesses, or try to reach information that is not yours.
  • Scrape or bulk-extract content, other than exporting your own business’s data with the tools we provide.
  • Resell or sublicense access to Hometown Club.
  • Upload anything malicious, or anything you do not have the right to use, such as someone else’s logo.

10. Your content and your data

You keep ownership of what you put into Hometown Club: your logo, photos, descriptions, messages, and, for a business, its member list. You give us permission to store, copy and display it only as far as we need to run the service for you and your members. Businesses can export their members, payments and visits at any time.

You are responsible for what you post and confirm you have the right to post it. We may remove content that breaks these terms.

11. Our intellectual property

Hometown Club, its name, logo, design and software belong to Hometown Club LLC. These terms give you permission to use the service, and nothing more. Do not copy, modify, reverse engineer or create derivative works from it. Print materials and graphics the service makes for your business are yours to use for your business.

12. Changes and availability

We are actively building Hometown Club, so features may be added, changed or removed. We aim to keep it running, but we do not promise it will be uninterrupted or error-free, and we may take it down for maintenance. Notifications depend on your device and its push service and may be delayed or not arrive. Keep your own records of anything you cannot afford to lose; exports are there for that.

13. Suspension and termination

You may stop using Hometown Club at any time. A business can cancel its plan in Settings, and ask us to close its account by email or from Help. We may suspend or close an account if these terms are broken, if the law requires it, or if we reasonably believe it is needed to protect members, other users or the service. Where we can, we will give a business notice and a chance to export its data first.

If we close a business’s account without cause, we will refund the unused part of any period it has paid for. Sections 5, 10, 11, 14, 15, 16 and 17 survive the end of this agreement.

14. Disclaimer of warranties

Hometown Club is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will meet your requirements, that any business will honor its memberships, or that any membership or perk is lawful where you are.

15. Limitation of liability

To the fullest extent the law allows, Hometown Club LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.

Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred United States dollars. Members pay businesses, not us, so membership fees do not count as amounts paid to us.

In particular, we are not liable for a business’s memberships, perks, prices or refunds, for what a business does with its members’ information, or for payments handled by Stripe. Some places do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnity

If you run a business on Hometown Club, you agree to indemnify and hold Hometown Club LLC harmless from claims, losses and reasonable legal costs arising from your memberships, perks and dealings with your members, your use of your members’ information, your messages to them, or your breach of these terms or the law, including alcohol laws.

17. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules.

Talk to us first. If something goes wrong, email privacy@hometown.club and give us 30 days to sort it out. Most problems end there.

If we cannot resolve it, any dispute will be brought in the state or federal courts located in Pennsylvania, and we each consent to their jurisdiction. Either of us may instead bring a qualifying claim in small claims court. If you are a consumer, nothing here takes away rights the law where you live gives you.

18. Changes to these terms

We may update these terms. If we do, we will change the date at the top, and if the change is significant we will tell businesses in the dashboard or by email before it takes effect. Continuing to use Hometown Club after a change means you accept the updated terms.

19. Contact us

Questions about these terms go to privacy@hometown.club. Business owners can also open a request from Help in their dashboard.
